The former 'Lost' actor allegedly punched Heather Borman when she refused to let him on board her privately-rented vehicle when he was intoxicated, and prosecutors have now taken photographs of a number of bruises on her arms and legs.

Matthew was arrested after the incident in Cleveland, Ohio, last Sunday , but was released pending Heather's decision to press charges, which she has since done.

She told Fox 8: "Right now it's considered a civil matter and that's why he was ultimately released Sunday morning, so I would have to press charges."

After Matthew initiated the attack, she retaliated, causing a cut to his lip.

He had to be pulled away by three men and was detained by an off-duty policeman until law enforcement arrived.

Speaking after the incident, Heather said: "I told him several times that he was trespassing, that it was a private party. He never said a word to me, he just stood there staring at me. He was inebriated and the smell of him was like a bar. After the third time I told him to get off my bus, he just stepped in for a right hook to my pelvis area and started wailing on me like I was a man.

"I had no idea who he was at the time. I did not know until after he was in custody. I'm pressing charges. Assault is wrong, I really do feel violated. He was hitting me in places I didn't think anybody would hit me... my breast area, my pelvis area."
