The Limerick man who was arrested in Boston on Monday, September 29 for exposing himself to two women at a city train station has been sent back to Ireland and placed on a two-year pre-trial probation.
Michael Joseph Brown, 34, with an address in Limerick City, was told at a court appearance on Monday, October 20, that the charges of open and gross lewdness and possession of a Class B substance, have been postponed, on the recommendation by medical professionals that he comply with all medications and mental health recommendations.
"In light of observations by mental health professionals at the hospital where Mr. Brown was being held, we determined that we could not in good conscience move forward with a criminal case," Jake Wark of the Suffolk County District Attorney's office told the Irish Voice on Tuesday.
Brown was put on a plane on Monday evening, October 20, in the company of his family and a physician and returned to his home in Ireland. "It seemed that the best result for all parties, including Mr. Brown, was for him to obtain the services he need in Ireland."
Brown was arrested after a woman, who he masturbated in front of, called 911 to report his behavior.
Brown, who spent 30 minutes exposing himself to various female travelers, was arrested at the by Transit Police at the Symphony Station at Massachusetts and Huntington Avenues and brought for psychiatric evaluation at Bridgewater State Hospital where he was held until his court appearance on Monday.
A small zip-lock bag containing a white powdery substance, believed to be cocaine, was discovered in Brown's jeans pocket.
Brown, who asked the females he encountered, if they liked his genitalia, was held on $100,000 bail. If he had been convicted, Brown faced up to one year in jail for possession of an illegal substance and up to three years in state prison on the charge of gross and open lewdness.
According to information Brown provided to police, he is single and living in Limerick. It is unclear if Brown was on vacation in Boston at the time of the incident.
If Brown complies with the medication and all medical and mental health recommendations made by his doctors in Ireland, he will not have to return to Boston for any more court appearances.
However, said Wark, stating that the case is still active, "Should we learn he is not complying with the terms of his pre trial probation he could be brought back to face charges."
