The member of the Belfast rap group, whose real name is Liam Óg Ó hAnnaidh, was charged with promoting a proscribed group after he was accused of waving a Hezbollah flag at a gig last November.
Following his case being adjourned several times over the summer, the case has been officially thrown out on a technical error in the way the charge against him was brought.
Speaking at Woolwich Crown Court on Friday morning (September 26), Chief Magistrate Paul Goldspring agreed with Mo Chara’s lawyers that the Attorney General had not given permission for the case to be brought against the defendant when police informed him he was to face a terror charge on May 21.
"These proceedings were instituted unlawfully and are null," Mr Goldsmith ruled.
Concluding the reasons for his decision, he said: "I find that these proceedings were not instituted in the correct form, lacking the necessary DPP (Director of Public Prosecutions) and AG (Attorney General) consent within the six-month statutory time limit.
"The time limit requires consent to have been granted at the time or before the issue of the requisition.
"Consequently, the charge is unlawful and null and this court has no jurisdiction to try the charge."

Supporters of Mo Chara and the group were outside Woolwich Crown Court in full force on Friday morning, despite being placed under a Section 14 order which permitted them to be a considerable distance from Westminster Crown Court, where the case was originally meant to be heard.
However, due to flooding in the area, the case was moved to Woolwich Crown Court — with Mo Chara wearing a tricolour balaclava similar to that of his bandmate DJ Próvaí, who wore his own in support of his bandmate.
Taking to Instagram on Thursday night, the band and its supporters announced the change of plans — writing "There’s a wee bit of flood around Westminster Magistrates court, so tomorrow’s hearing has been moved down to Woolwich Crown Court instead.
"Same time. Same craic. Different Venue. Woolwich Crown Court, 2 Belmarsh Road (yikes!), London, SE28 0EY.’
"We hope you can still make our Fenian Fleadh and be there to support Liam Óg and the lads from Kneecap."
