An Irish nanny accused of murdering a toddler in her care will face trial next April, her lawyers have told a Massachusetts Court.

On Wednesday Aisling Mc Carthy Brady’s defense attorney appeared in Middlesex Superior Court outside Boston for the brief update hearing.

McCarthy Brady of Quincy is charged with murder and assault and battery on a child in the death of Rehma Sabir last January. The toddler was admitted to hospital on her first birthday with severe head injuries and died two days later on January 16. The Irish nanny has plead not guilty to the charges and has been in custody since her arrest on January 22.

The 35-year-old Irish immigrant, originally from Lavey, Co. Cavan was not in court for the short pre-hearing.

On Wednesday Defense Attorney Melinda Thompson told the court her legal team was still awaiting medical and radiology reports from the District Attorney regarding the existence of bone fractures.

Assistant District Attorney Patrick Fitzgerald said during the five minute hearing that he was 'hopeful' the trial would proceed next April.

Judge S. Jane Haggerty urged the prosecution and defense teams to “exchange what you need to exchange” so the trial would remain on track.

Judge Haggerty said she was still considering a motion from McCarthy Brady’s attorney to have the charges dismissed on their claim that 90 percent of the evidence presented before her indictment was inadmissible.

Another hearing is scheduled for November19. The defendant is expected to attend that hearing.
