Court ruling on the release of Boston College’s IRA tapes a disaster

College made first error giving assignment of interview with IRA and Loyalist leaders to journalists

The first thing that needs to be said about the Boston College fiasco is that the college made a serious error in giving the assignment to interview former IRA and Loyalist leaders to journalists Ed Moloney and Anthony McIntyre.

Both men had serious anti-Sinn Fein agendas, arising out of their opposition to the party’s strategy with regards to the peace process.

That made the Boston College exercise of conducting interviews from 2001 to 2006 a deeply partisan one, with many concluding that the aim was to get Gerry Adams and other former IRA leaders who went the peace process route.

That was certainly evident in the Voices from the Grave book by Moloney, which contained many allegations against Adams by former IRA commander Brendan Hughes with no counter argument or perspective given.

The fact that Hughes was a very ill man at the time of the interviews and had split with Adams over the peace process was important information.

The second major error by Boston College was allowing the interviewees to assume the assurances that their testimonies were guaranteed to be kept secret until they passed away were correct. This has proven to be a deeply flawed belief.

That was not so much the error of Moloney and McIntyre, who are not legal specialists, but of the college itself, which did not carry out the necessary legal investigation to see what the liabilities really were.

Fact is, as Judge Patricia Lynch pointed out in her statement upholding the release of the tapes, a previous Supreme Court judgment upholding the government’s case that they were entitled to access if the testimony contained possible evidence of a crime was utterly missed by the college.

Now we have a deeply troubling situation where secret evidence will be handed over, and a very damaging precedent for future oral history projects, whatever the topic.

It is very unlikely that there is any earth shattering evidence in the tapes.  Most speculation surrounds the Dolours Price evidence on the Jean McConville killing, one of the most notorious of The Troubles, but she pretty much gave the same evidence, it is believed, in an interview with The Irish News with no subsequent actions.

Price and her sister Marion became deeply estranged from Sinn Fein over the peace process, so like Moloney and McIntyre, they have every reason to paint figures such as Adams in a negative light.

What we have overall is a botched oral history project that reflects very badly on Boston College, which apparently carried out very little due diligence into the researchers and their particular political agenda.

The only alternative to that scenario is that Boston College cooperated willingly with a deeply biased and skewed version of the peace process and how it came about, which is hard to believe.

Either way the damage has now been done and the British authorities, who willfully ignored so many murders over the years, now is suddenly agog at “new” evidence in the McConville case -- or so we are led to believe.

seano - lived in the Falls, in Official SF, served in BA, walked Markets, Short Strand, Tigers Bay, Shankill, never met an opposing soldier on either side, only cowards who put balaclavas on to hide their faces to shoot innocent people, that's not serving in an army who are bound by the rules of engagement, are subject to the laws of the land, you need to wake up, the loyalists have had investigations quite rightly into their atrocities, but we haven't had enquiries yet into FF setting up PIRA in 69, Finucane, Bloody Friday, Teebane, there's going to be plenty of shocks in store & the major british infiltrated shinner has yet to be exposed, though as they say, most of the dogs on the street suspect who he is
"stickies" that figures. One BA terrorist patting another BA terrorist on the back.I suppose you loved shooting nationalists children in the back with your plastic bullets(which you never used on loyalist rioters that was a no no.Get my point you reprobates.
Well said FallsRNat.
seano never answers the actual question, just pours out his bile on anybody who doesn't support his provie mates, let's deal in reality, when i was a squaddie in Belfast, i was approached 7 threatened by a PIRA member, as i said then & stick to now, I said if you come armed, i won't hestitate for a second, of course they never lived up to their promise of a 1 on 1, they like their loyalist buddies like to shoot unarmed civilians who are caught & surrounded by them & their buddies or leave bombs that result in carnage on the civilian population. My family are a well known bunch of 'stickies', they do hold a grudge & even though i wouldn't have countenanced it, i'm sure retribution would have been swift on PIRA if anything had happened to me, i served with a guy whose brother was in the UVF Maze for 11 years, so what, us like our other BA mates were there protecting the innocents from these murderers, there will never be peace on the island of ireland until the paramiltaries on both sides acknowledge their brutal campaigns waged on innocent civilians
seanomelb, the rantings of a true Irish bigot; ignorant of the past and falsifier of that past. I have nothing against the Irish, the Brits or anyone really; except people who murder and people who sponsor that murder. I know that my actions resulted in a few people, some Roman Catholic and some Protestant, not being killed. My purpose in the Army was to prevent murder; to protect people. Hell, the orders that I operated under, specified in the 'Yellow Card' laid down rules that prevented me from opening fire only in dire situations. Terrorists had no such rules and they murdered indiscrimately. So I condem murder by anyone while you sponsor murder. that is nice to know. I also know that you are the type that spouts a lot but with out substance; you just repeat the old mantra of republicanism; I'm a poor Catholic, I've been discriminated by the proddies, I love to hear that Cops, soldiers and/or innocent civilians have been killed, I think the sun shines out of Gerry Adams'arse, I think that the IRA was right to destroy all the industry so I could live a life of poverty on the dole. You are a true low life.
A couple of British army terrorists Fallsers and Schon, trying to justify their anti nationalists behaviour. I wonder how many Iraqis or Afghanis did they murder in the name of the queen or were they stationed in the six counties terrorizing Nationalists children. you're just a couple of British apologists justifying your murder and bigotry. You,re a couple of lowlife excuses for a human being, without honour or respect.Schon you know nothing about me or what I was involved in,but I now know what you are (as stated above) go wash the blood of the innocent from your terrorist British hands.
Nobody should be surprised by the anti protestant bile spewed out by seano & his alter ego sirpeter, these people want the prods out of ireland so they can live in their quasi PIRA sponsored marxist state, what next, Wolfe Tone's body floated down the Shannon. It is particularly galling for someone like me whose family were involved in 1916, through to the late sixties & yes, I served in both the Official Sinn Fein movement in the 70s & later the British Army to contend with them who know nothing about irish history & what a free state should represent for all of the people both North & South on the island of Ireland
and further seanomelb with respect to your reference to the 'bigoted anti Irish Orange order RUC', it is telling that the PIRA undertook a campaign to kill Roman Catholic members of the RUC in the early 1970's, the same as they did to the RIC prior to partition. PIRA's intention was to create a force that they could refer to as a protestant force, but even though they failed to drive all Roman Catholics from the RUC, my brother-in-law remained in the organisation until retirement. As usual the republicans and their apologists lied and referred to the police as being the protestant RUC. The B Specials were created to protect the rural population from the sporadic IRA campaigns that happened over the years since partition. Again you are wrong when you say I sat on my hands during this period. I didn't. I was in the British Army and am proud to say that I and my comrades successfully foiled a number of murders attempted by both the republican and loyalist murderers. I also witnessed the aftermath of a number of bomb blasts and assassinations. I see you as a typical Irish lackey, all mouth and no substance; a little toaddie who would relish the chance to kill innocents but if only he could find the balls to do it.
seanomelb you really should attempt to rationalise. The protestant population of the South was approximately 25% immediately after partition. In 1972 the protestant population of the South was less than 5%. However, in the North the Roman Catholic population on partition was approximately 25% while in 1972 it was set at 42%. The reason the prods moved from the South was due to intimidation and discrimination. They at least were intelligent enough to know where their bread was buttered and take appropriate action. But the poor suffering Roman Catholics in the North, besides suffering from the predation of the pedophile priests, saw their population rise from 25% to 42% even though they claimed to be discriminated against. Imagine living in squalor and deprivation of the North when they could have joined their co-religionists in the South and benefited from the bounty of the failed facist Irish state and economy. They sat in the North like parasites and, while claiming all sorts of privations, they accepted the money doled out to them by the British Exchequer. So while the population of the South endured poverty and dictatorial rule, the minority population in the North lazed in the glory of the British Empire for 90 years while complaining like spoilt children, living like kings compared to their co-religionists in the South.
Schon if you wish to give a clouded impartial point of view that's OK. I suggest to you that the nationalists of the six counties had every reason to mistrust a bigoted anti Irish Orange order RUC whose Raison D'etre was to terrorize the nationalists so they could have a bigoted protestant state not to mention the B SPECIALS. Living like second class humans for almost 90 years under an orange jackboot was ended when the IRA brow beat the bigots to the negotiating table with Armalites and bombs and you lot just seethe at the advances made in the 6 counties.I make no apologies for the IRA campaign and cretins like you who sat on your hands and were happy with the status quo at that time should hang your collective heads in shame for the bigots you are.
To IrelandNorth... the answer to your last question is a resounding NO!
maireadinmelb are you anything to that reprobate seanomelb? Isn't he a one? Of course the US Government should assist the Brits in their campaign against terrorism. After all the US is fighting against terrorism too, or did nobody tell you? Deary me but you supporters of murders really should read the news... or better still, get a life. During the Troubles, republicans refused to deal with the Crown services and their refusal meant that criminal actions taken by the republican community and against the republican community were unable to be investigated. The investigating offiers of the RUC were in the habit of getting shot and blown up by these poor innocent Irish terrorists while attempting to perform such investigations. Anyone 'grassing' to the authorities risked being knee capped, remember?, or murdered for doing so. With respect to Jean McConville, the authorities have investigated and know mainly who did what. Unfortunately the evidence is not sufficient to charge anyone as no one has been prepared to say so in court, that is until Marrion and Brendan made their submissions to the Boston College, silly billies. Hence the request for sight of the transcripts. Also, with regard to the unionist crimes, perhaps you would like to identify the particular unsolved unionist crimes you are talking about so I can investigate and find out the status of the investigation? Please, please, please, if you have objections, identify them specifically. Don't just hint at some nebulous generality. Doing so only emphasises your ignorance and inability to formulate considered arguments. That goes for you too, seanomelb, you cheeky boy. Luv and kisses.
Hi seanomelb, Nice to see you are dissembling again and I have to used my closed minded view to relate the truth... again. The Boston papers relate to the nefarious do's of both sides in the conflict, so I hope that the loyalist thugs also get done for their crimes. The loyalist side was never so organised as the republican and quite a lot of the boyos released as a result of the Good Friday agreement were loyalist thugs who had been shopped and convicted of bloody crimes. If you examine the number of outstanding unsolved murders in the Province it is noticeable that the republic murders have a lower rate of conviction than loyalist. This is due both to the inbred mistrust of authority, which is taught in the maintained education system, (a type of aparthied insisted on mainly by the Roman Chatholic church and, strangly Paisely) and the fear of reprisals from the republican thugs who have gone out of their way to incite loyalist reprisals against, in many cases, innocent Roman Catholics and others. The Irish really need to get rid of this inferiority complex that seems to run through Irish history. Either that or start supporting the side that is going to win. The Irish have the unfortunate inability to support winnersas seen in for example; King William of Orange and his sponsor Pope Alexander VIII vs (Deposed King) James II and the World (nearly) vs Adolf Hitler.
To British imperialism - even Mahatma Ghandi was a terrorist! The sad history of Anglo-Irish (imperialist-republican) relations has been a concertina effect down through the centuries, between protracted periods of constitutionality, and abbreviated periods of intensse armed conflict. For imperialists, peace processes are very often about dividing and conquering an enemy who threatens what they see as their God given right to govern other peoples territories. Question is: Do the English ever learn?
To the writer, it is ok for people to have a differing opinion to that of Gerry Adams! Further Hughes has had his say in the book Adams is alive and has a right of reply. He is a big man a grown up and an author! He has been accused of many things by many people far worse than anything Hughes said. The book you refer to does not hide away from the fact that Hughes fell out with Adams - read the book with that in mind provides context. Boston COllege and US government should not be doing the dirty work of the british! They have had many years to investigate the death of Ms McConville and only choose to act now! The british forces have not properly investigated sources they have access to for many other "mysterious" deaths when they use the resources they have in their control first they may be taken more seriously. Also when they seek details of crimes committed by unionists and so called security forces.
