Tara Driscoll the Irish American teacher in New York who is accused of raping her 16-year old student is guilty of stupidity not rape.
The boy was within months of being the legal age in New York of 17 and would have been legal age in dozens of states.
I also firmly believe there is a difference between a 33-year-old female and a 33-year-old male carrying out that same act.
There are deep biological differences between the sexes girls and boys.
Boys are hardwired from their early teens to seek to procreate.
Sex becomes an all-abiding search for knowledge and the curiosity is intense
An older woman is seen as a divine way to begin the understanding of that process.
There's even a great movie about it, 'The Graduate.'

Young men were all looking for a Mrs Robinson around that time I remember.
Not for nothing did lords and nobles in London in times past send their sons to hookers to become properly initiated in the art of intercourse.
This young man just experienced what every 16-year-old boy would fantasize about at one time or another.
I just don't go for the political correctness that he was raped because he was a few months underage,
i think Driscoll seems like a sad case, a woman who had alcohol problems and had been transferred from her teaching job months earlier.
But do I think she was a rapist? Not at all. Troubled, stupid and guilty of bad judgement yes.
But no, not a rapist.
The young man will probably end up bragging about his experience in years to come-- that is the way of the world folks..

I don't care if this guy was 21. As long as he was a STUDENT, the teacher had no business having sex with him. TEACHERS ARE NOT SUPPOSED TO HAVE SEX WITH STUDENTS! Period.

Good point, Kelley65. As I said yesterday, under the 1st article on this subject, penalties should take into consideration the impact on the would be victim. I also alluded to the older age factor. A woman having sex with a 16 year old boy, shortly before he turns 17, is way different than her seducing a 13 or 14 year old boy. Remember Amy Fisher? She was a couple of weeks shy of 17 when Joey Buttafucco(spelling?)had sex with her, I think in 1992. Joey only got 4 or 5 months behind bars. This reflected the principles I was citing, that the age & impact on the perceived victim should be taken into account, when penalties are issued. Yes, "statutory rape" is indeed a severe term for having consensual sex, with an older minor. Maybe "unlawful sexual contact, with a minor", would be more appropriate.

Bottom line, it is against the law to have sex with a minor. She had sex with a minor. She broke the law and should be punished. Period. Perhaps what should change is the wording of the law, statuatory rape. Rape is a repulsive, violent act perpetrated against a persons will. Statuatory rape is sex with a minor, even with consent, called rape under the guise that a minor can't really consent because they do not fully understand the ramifications of that act. Now when a minor is raped, that is called molestation. That wording needs to change as well, because it is rape, plain and simple.

Katiemac, Roberts' argument in this article is far from "liberal." The USA has child protection laws, worker protection laws, civil rights protections, consumer protections, and environmental protections today because liberals worked hard to pass such legislation! Conservatives are currently working hard to dismantle it: check on what's been happening in Wisconsin, for example, and on the GOP's attempts to undo collective bargaining rights as part of the federal budget deal. Furthermore, liberals are not by definition "relativists"-- an ultra-conservative Catholic canard! Liberals think their way through a moral issue on the basis of sound moral principles and values. You write, "That is the problem with liberals, they cannot make up their minds as to what they believe because everything is 'relative'." No, this article is an aberration for Patrick Roberts, or maybe it's tongue in cheek to stir controversy as someone else commented below. But it cannot win the support of any thinking liberal. I'm about as far to the left as anyone can get and still stay out of prison for sedition, and I see Roberts' opinion on this issue as clearly and completely wrong, in danger of undermining equality under the law and the essential duty of government to protect the rights of children and adults. The people who try to dismantle those protections are conservatives, so get your name-calling right.

This is a complex situation, which involves a recovering alcoholic and a sexually aggressive young man. The young man is enamored by this lovely young woman, and she suffers from low self-esteem and seeks love and security on some level. Stupid move yes, rape absolutely not. Mostly very much a consensual act by both parties. Ms. Driscoll needs counseling and so does the young man. My hope and spiritual thoughts are with them both. For the record I am a health care professional and have treated many alcoholics and drug addicts with a lot of psychological problems.

I'm sorry, but I consider myself to be a liberal and I don't condone what this article's writer is saying at all! Statutory rape is not relative. Man or woman, the perpetrator should be punished equally under the law. Whether a teen be male or female, they are both susceptible to the advances of an older authority figure. You may say he'll "brag to his friends" about this some day, but that doesn't make him any less of a victim.
