Jamie Eisel, the separated husband of $21 million New York lottery winner Patricia Daley Eisel, is said to be suing his wife for a share of the proceeds and has retained a lawyer, sources tell Irish Central.
Jamie, an ironworker, left his wife and has since taken up with a new girlfriend. He and Patricia have three children together.
The couple never finalized their divorce. He was found to have $9,400 in debts after her win surfaced.
The Long Island waitress, originally from County Offaly, had her big win which worked out to $8 million after taxes in January.
She only played the lottery after being forced to stay in the U.S. when bad weather canceled her flight to Ireland at Christmas time. Lawyers say the fact that he was not divorced may well make him eligible for a share of her prize.
Patricia’s co-workers at the Saloon Bar in Long Beach believe he shouldn’t get a share. One waitress told The New York Post after her win: “They had a contentious relationship. I bet [Jamie's] sorry now. She looks better than she ever did. She looks like she's glowing."
Daly Eisel said at the time her win was a godsend.
“I have been in America since ’95. I babysat at first and right now I live in Long Beach. I waitress and bar, tend and mind kids.
"It’s a struggle to keep it all together but it’s good – the bar’s good where I work. But this is going to make it a lot better."
She has sworn "to keep life normal, no big purchases." She even said she’d keep working "for a while."

The lawyers saying "the fact he was not divorced may well make him eligible for a share of the money" are likely the lawyers drooling over the thought of getting a fat 40% contingency fee for representing either party. Don't know the state law in New York, but in Pennsylvania, once the parties separate, as in husband moves out of the family home, there are no joint rights to inheritances, windfalls, stock dividends, bonuses, etc. Even if the law clearly precludes a claim, lawyers will still take a case in hopes of getting a settlement for a "nuisance claim." That is, it would be cheaper to pay the jerk husband off with something rather than pay legal fees to keep fighting him in the courts.

Lets face it, 52% of marriages fail,A lot of times the marriage has failed long before one or the other starts a new relationship,there are reasons, that are personal,not criminal, I would find it difficult to deal with, if my wife choose to work in a bar, and men hitting on her daily.Regardless of divource or seperation, they still are father and mother to the children to be raised. Let a judge decide if he is entitled to any of the money. IF history is a lesson, Past lottery winners ended up miserabe,lost their loved one"s,friends etc..I hope it builds a healthy future for the children..

Obviously he is very selfish and a jerk. He left her, which means he did not want anything to do with mending their relationship, he was with another woman (adulterer). He SHOULD NOT be intitled to anything she has earned or won in any fashion due to the fact that he was no longer in the relationship. If he was a decent man, he should be pleased that she can now spend more time with her kids (as parents should do) versus taking meanial jobs to earn money to provide for of his kids. I don't know how the relationship ended but if he was decent to her and it sounds like she is a decent woman, she may have offered to pay off his bills or maybe even given him a little of her winnings to help him out. BUT...to just try to take it from her and his kids is not a good thing. HE MADE HIS BED, NOW HE MUST LIE IN IT. His kids will always remember what he did, but some people will lower themselves with no disregard for anyone else just for money. It's too bad she didn't get the divorce before she collected her winnings. A brief short story (one of many): My aunt who was president of a bank was married. Her husband left her and she did not see him for 18 years. She never met anyone to want she wanted to marry and obviously he did not either, so neither one ever filed for divorce. When she died at an early age she left all of her money to all of us. Her husband crawled out of the wood work along with his attorney. The fight went on for so long that there was nothing left for anyone. Shame on him and shame on Daly's husband. Satan works in many ways.

What a pathetic excuse for a man. America is faltering because it's become a place of little honor, little sense of duty, too many without the stones to stake their own claim, and get by their own effort what they expect or demand others provide for them. This is just another example of such. On the other hand when this slug left her for another woman she should have gotten a divorce, the price of stupidity is high.

Whats sauce for the goose....... and if he has any sense he will divorce in Ireland when you can keep going back for more as often as he likes even after the divorce is granted. It shows how unjust the law is. Women have been taking advantage of this for years so now its a mans turn. Seems right somehow to have a man claim even though he is obviously an a**hole.
