Irish nanny to remain in jail until fall murder trial

The Judge has postponed the trial of Aisling Brady McCarthy until October.

McCarthy is accused of murdering a one-year-old infant in her care in January 2013. The infant, Rehma Sabir of Cambridge, was hospitalized on her first birthday with severe head injuries and died two days later.

At Middlesex Superior Court in Woburn on Friday (Mar 14) Judge S. Haggerty ruled in a scheduling conference that the case will go to trial in October. The original trial was scheduled to commence this April, but due to delays in the handing over of exculpatory evidence to the defense, it had to be postponed.

The defendant's lawyer, Melinda Thompson, advised the court that they were still awaiting some of the evidence and that they would prefer a Fall date commenting, "We want to be ready in April but we want this done right for Ms. McCarthy and we are put in this position where our experts will not be ready."

Judge S. Haggerty agreed with Thompson that she did not foresee the defense being adequately prepared for a summer trial. When asked his opinion on a later trial date District Attorney Fitzpatrick advised the court that the Commonwealth did not contest such a proposal and a new trial date was set for October 14, 2014. The trial is expected to take four weeks.

A status hearing has been scheduled to take place on April 11.
