Irish NY lottery winner may be forced to share winnings with husband

According to a famed New York divorce attorney, Irish New York lottery winner Patricia Daly Eisel may have to share her $8 million win with her estranged husband after all.
 
Jamie Eisel, her husband, left Patricia and her three sons last summer and is now seeing someone else. Friends told the Daily Mail that Patricia was devastated by the break up.
 
Last Thursday she found out that she had won $21.5 million ($8 million after taxes) in the New York State Lottery, and she thought that her luck had changed. However, it now appears that her husband could have a right to claim half of her winnings.
 
New York divorce attorney Raoul Felder told the New York Post,  “On first blush, he might actually have a claim.” He said that the case would be determined on how long they had been separated and how much he helped out financially.
 
It has not been determined whether Jamie has decided to make a claim. His financial records show that he owes about $9,400, according to the New York Post.  He could not be reached at his Long Beach home for comment.
 
However, speaking to Patricia’s co-workers at the Saloon Bar, they believe he shouldn’t get a share. One waitress said, “They had a contentious relationship.  I bet [Jamie's] sorry now. She looks better than she ever did. She looks like she's glowing."

Honest to God. I still don't get why some people are name calling the poor schmuck without knowing the first thing about why they are separated.
I hope he doesn't get a penny. Spend it all before he gets his hands on it. Have a ball with you children and tell him to take a hike/ Best of Luck with your winnings.
I know someone who won the lottery and it took them 4 months to get all their affairs in order before they claimed it. Set up trusts, etc to minimize taxes. Why did she not think about this and divorce his ass before she claimed the money!! alot to be said for staying hush for a while.
Men for years have had to pay, pay and pay no matter what their faithful bird dog did. As woman have been so finely tuned to believe, "what mine is mine and what's his is ours".
what she should do is get a divorce then make him pay back child support change the kids last name to hers then write him a note to jump off the brooklyn bridge, who needs a scum bag in your life.i guess she was in love, pity

If I were the judge I'd give the husband 50%. There's plenty for both.
Get real sisters and join the real world-just because its usually women are the leeches does not mean he cant claim.Of course he can claim. In a recent case a woman sold her company for 30million. Even though they had divorced many years previously the court ordered her to pay him 10.5 million. If he claims in Ireland under the Family Law (Divorce) Act 1996 he will get 30-50%. In Ireland there is 'no fault' divorce so his behaviour does not matter.He can claim under this as his wife is Irish. Its unfair-usually on men-but thats the law. Mind you if all was well in the marriage he would not have left. There is also no 'clean break' divorce in Ireland so either party can keep going back to the court even though both of them may have remarried. I say this as a specialist in Irish Family Law.
To whom does he owe this money - child support? If so, he shouldn't get a penny.
I'd give him 1000 dollars.
This is why when a spouse walks out you file for divorce IMMEDIATELY. When they walk away from responsibility so they can see someone else you do not want them back. This of, of course, includes scumbag men who walk out and women who are "trying to find themselves" (since that seems to be a common theme when women walk out).
She MUST be wise, smart and dutiful in her thought & action. She MUST not forget what he has done to her three boys and herself. Grant it he is the boys FATHER but thats were it remains..Be a FATHER! Seek good legal advise!
