A Belfast judge has ruled that laws prohibiting unmarried and same-sex couples to adopt children, breached their right to family life.

Up until now, only married couples and single adults, including homosexuals, could adopt in Northern Ireland. However, couples in a civil partnership could not. But the ruling will overturn the 1987 adoption law.

The verdict came as a result of a challenge to adoption laws brought by the Northern Ireland Human Rights Commission, UTV reports.

Speaking following the High Court ruling on Thursday, Mr Justice Treacy said: "The present legislation essentially entails that a gay or lesbian person must choose between being eligible to adopt, or affirming their relationship in public via a civil partnership ceremony."

Health Minister Edwin Poots, an evangelical Protestant, has said he intends to appeal the High Court ruling.

“I am not convinced that today's judgment is ultimately in the best interests of some of the most vulnerable children in Northern Ireland,” Potts said.

"A decision to place a child for adoption should be made on the basis that it is in the best interests of the child to be adopted and following a process of thorough assessment to determine that this is the case," he said.

"The welfare of the child is the central tenet of the main body of children's law in Northern Ireland- and this extends to adoption law. No-one has a right to adopt a child and, even when approved, prospective adoptive parents may or may not be deemed suitable to adopt a specific child - this relies solely on the best interests of that particular child being served by that arrangement.”

NI Human Rights Commission Chief Commissioner Professor Michael O'Flaherty has welcomed the ruling.

"Through this case, the Commission has sought to protect the best interests of the child," he said.

"It brings Northern Ireland law in line with the rest of the UK and means that couples who are not married, those in civil partnerships and same sex couples, will be now be allowed to apply to adopt.

"Mr Justice Treacy agreed with the Commission that preventing someone from even being considered to adopt because of their relationship status is a discriminatory practice."

According to AP, around 2,500 children in Northern Ireland are in state care awaiting adoption.

One is all for gay couples adopting children, but adoption by singles or homosexuals is disturbing in the extreme. It's understandable that sexual inverts would seek to adopt to compensate for the biological contradiction of their symetrical sexuality. Alas, this judgement exposes the poverty of psychology by members of the Anglo-Irish judiciary who don't know their arse from their elbows. Society is far more complex than mere laws and legalities. I suggest they read neo-Freudian French psychoanalytic psychiatrist Jacques Lacan to apreciate the hazards of single parenting. And multiply his prognosis by two to appreciate that of homosexual parenting. A generation of existentially confused children will be reared by such parents (sic), and a small vociferious unrepresentative minority will continue to engage in megaphone diplomacy in doing theri devil's work.
Mairint. There are many many cases of such disasters. Makes it sound a bit like many of the children requiring adoption have already been just that by gay people and it didn`t work out. Is there a larger percentage of gay couples who split up in comparison to straight couples ?.
Pity you are not aware "olovely" that a child needs a mother and father NOT adults who fancy having a child for whatever their reason and by fiddling around with sperm and eggs from whatever source. A marriage of two people of opposite complimentary gender, who love each other in the normal way that lasts a lifetime, through fair weather and foul (stick together when ill or not so slim and svelte any more), stay faithful and honest, and provide the security of continuity, - all proven to be the cornerstone of society. The weird and abnormal playing at being parents by people of the same gender is a selfish environment into which one brings a child. There are many, many cases of such disasters - left wing media ignores that as it is not in its agenda.
What does the child need? A protective environment, love, kindness, enrichment and protection. Can people of the same sex or opposite sex provide that - yes, obviously. Marint your comment that gay couple are being selfish for adopting is so stupid and short sighted it doesn't require further derision from an adult. By your standards all single parents are unfit parents.
mairint - you are dead right.
this is SUPER NEWS...what i don't understand is; WHY allow single gays to adopte and NOT couples?....if your going to discriminate against gays...why not ALL of them? alisa
Jerry and Dottie Sandusky of State College, PA were permitted to adopt six children and foster many others. No questions asked for that solid, opposite-sex couple, religious, couple. While many questions are asked for those who don't fit the mold that the strict religious crowd has determined is best for society.
What do so called "Human Rights" crowd know about what is best for little children? The term Human Rights has been hijacked by homosexual and feminist activists. Little children have become a marketable commodity for the "I want"s. Nothing has changed in what is best for a child, a mother and father in a secure state of marriage. Not two guys who 'want' to be 'parents' by whatever means, not an aging single woman whose 'biological clock' is ticking away and 'wants' a child through some other way...How tragic for the children of the future. Already many children from constructed situations worry about their true origins and long for normalcy. Selfishness reigns.
Yeah, CelticQueenUSA, your handle explains your stupid opinion. Even if these children have "love" -- a dubious proposition at best -- the couples involved are guaranteed not to have children. Basic plumbing tells us why. (Tells most of us why, at least; I can't speak for screwed-up sophisticates like Queen here.)
A GREAT step FORWARD. Children will have homes and love. Wonderful.
