The family of Savita Halappanavar, who died in a Galway hospital last month after being refused a pregnancy termination for a baby she was miscarrying, has given the government until Thursday of this week to agree to an independent public inquiry or face a European court battle.

Their demand came as the Irish Cabinet on Tuesday considered the report of an expert review group on abortion.

Savita’s family’s move is effectively a rejection of an inquiry by the Health Service Executive (HSE) and a separate one by the Health Information and Quality Authority (HIQA).

Savita’s husband Praveen said he had no faith in the HSE probe into the deaths at the Galway University College Hospital. He also rejected the HIQA probe which was launched last Friday.

He has said if there is not an independent public inquiry he will take a European Court of Human Rights case.

Savita’s father, Andanappa Yalagi, also made a direct appeal from India to the Irish government to hold an independent inquiry.

Savita, 31, from India, who worked as a dentist in Westport, Co. Mayo, died of septicemia on October 28, four days after asking for medical termination when she complained of bitter pain and was told she was miscarrying her fetus of 17 weeks.

Her husband Praveen, 34, an engineer at Boston Scientific in Galway, said the termination was refused because the fetal heartbeat was still present and the couple were told, “This is a Catholic country.”

When the fetal heartbeat stopped the dead fetus was removed and Savita was taken to the high dependency unit of University College Hospital, Galway, and then the intensive care unit, where she died.  The Irish Catholic newspaper said this week that Catholic theology and the law did not stand in the way of doctors treating Savita.

But the Irish government is under growing pressure to legislate for abortion in limited circumstances after an expert review group came down in favor of clarifying the situation by way of new law and supporting regulations.

The review group was established in January and its report was presented to the government last week.
 The contents of the report by the review group, discussed at Cabinet on Tuesday and published later that day, were already leaked to media last weekend.

The European Court of Human Rights has ruled that Ireland failed to properly implement the constitutional right to life of the mother set out by the Supreme Court in Dublin 20 years ago in the X case. The court decided that the life of the mother must be at risk, but it left the power with doctors, excluding the woman’s views.

Thanks, Schlomo! I see now he/she/it (NXS) has decided, that because Ireland has one of the best safety records, he/she/it now calls it "lucky" instead of "unsafe". What a total PLONKER!!! Now, if NXS's mother had availed of abortion on demand in whichever part of the world he/she/it hails from, we wouldn't have to put up with any of he/she/its mumbo-jumbo-dumbo-numbo. "NXS" - What an amazingly STUPID comment. We don't have "abortion on demand" in Ireland, therefore, the unborn child does not have that particular impediment - popular in most countries - standing in its way of being born. Secondly, despite all the gross misrepresentation of Ireland's being an "unsafe" place to have a baby, we have almost the very best safety record of childbirth in the world. And also, despite the rampant accusations, I would point out the figures of maternal death (that's death of the mother in childbirth for your own edification) in one randomly selected hospital in Ireland (The Coombe, Dublin) for the years 2000 - 2011 (11 years) show that 105,000 babies were born and five mothers died in all of those childbirths. Now, do you want to apologise, TWIT??!!? (BTW, I added "TWIT" because you apparently consider that it's all a laughing matter) Éamonn, Dublin

I AGREE WITH THE FAMILY ON THIS....imo, the hospital staff did WRONG...they put RELIGION before the LIFE of the mother.....had she lived, she might have been able to have MORE kids....but, they didn't GIVE her that chance. alisa
Pro-choice organizations are understandably disappointed with "the report’s narrow interpretation of the circumstances where abortion should be permitted." Yes, the group that produced the report after nearly a year's work had a narrow remit. In his Preface to the Report, Sean Ryan writes, "We are aware that the matter we are asked to consider, which is essentially a technical question or a series of technical questions, is part of a larger discussion or controversy." Nonetheless, the group had no power to deal with the larger questions. Its task was simply "to recommend a series of options ... to implement the [Supreme Court's judgment in 'A, B, and C v Ireland, re: Article 40.3.3 of the Irish Constitution] taking into account the constitutional, legal, medical, and ethical considerations involved in the formulation of public policy in this area and the over-riding need for expeditious action." It is unfortunate that the result will most likely only clarify, rather than repealing, Article 40.3.3, which holds the right to life of women miscarrying pregnancies hostage to a foetal heartbeat.
There are so many priests, preachers, and assorted shamans out there -"men of the cloth"- who have the unmitigated gall, the sheer arrogance, of claiming to speak for God, and with God.
