The 29-year-old actress has allegedly filed court papers against her mum, Nuala Barton, claiming she is "a greedy stage mother" who took money from her salary and kicked her out of her $7.8 million Beverly Hills home, in which her parents now live.

In a statement to PEOPLE magazine, Mischa's lawyer Alex Weingarten said: "From the outset, Nuala positioned herself to siphon her daughter's hard-earned money by purportedly acting as her talent manager - a role for which Nuala had absolutely no experience or training."

The complaint explains the blonde beauty is suing for damages and court costs after the "personal and professional" breakdown of their relationship, due to Nuala's inappropriate handling of her finances.

It reads: "Nuala currently refuses to provide Barton with any of the funds she earned (and continues to earn in the form of residual payments) for her acting, modeling and endorsement services.

"These revelations of exploitation and fraud, coupled with ongoing instances of bullying and verbal abuse, eventually led to the breakdown of Barton and Nuala's personal and professional relationship."

One specific argument in the lawsuit is over the fee she received for her role in the upcoming horror movie, 'The Hoarder', after the actress discovered her mother had lied about her salary.

According to the star, Nuala claimed Mischa was being paid a certain amount, although she later discovered her salary was far higher and her mother had been claiming the additional money for herself, as well as a 10% management fee.

In the complaint, the 'The O.C.' star added neither her photographer mother, or father, Paul Marsden Barton, have had jobs independent of her for more than 10 years, and claimed her mother has, "exploited [Mischa]'s name to start a handbag line and a fashion boutique."
